Terms of Use

These Terms of Use ("Terms") govern your access to and use of LaLaLista (the "Platform"). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. What LaLaLista Is

LaLaLista is a free, self-service classifieds board. We provide the space where users post and browse listings ("Ads"). We do not create, verify, inspect, endorse, or take part in any Ad, transaction, job, sale, purchase, or interaction between users. We are not a party to any agreement between users.

2. No Warranty, "As Is" Service

The Platform is provided strictly "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted/error-free operation. We do not guarantee that any Ad is genuine, accurate, safe, legal, or will lead to any particular result.

3. No Financial Guarantees

We make no promise, guarantee, or representation that you will earn, receive, save, or recover any money, income, sale, job offer, or other financial or material benefit from using the Platform, including from posting, promoting, or purchasing visibility for an Ad ("Sponsored Ads" or "Banner Ads"). Any amounts paid to us for visibility/promotion pay only for that placement service — never for any outcome, result, sale, lead, or amount of money. Purchasing promotion services does not entitle you to a refund based on results achieved (or not achieved).

4. Limitation of Liability

To the fullest extent permitted by applicable law, LaLaLista, its owner(s), operator(s), and any affiliated individuals shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of money, profits, data, goodwill, or other intangible losses, resulting from:

• your use of, or inability to use, the Platform;
• any Ad, content, or conduct of any user or third party, online or offline;
• any transaction, communication, meeting, payment, job, or agreement arranged through or in connection with the Platform;
• any scam, fraud, misrepresentation, injury, loss, or dispute connected to another user or any third party.

This limitation applies regardless of the legal theory asserted (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages, and even where a remedy fails its essential purpose. Where a jurisdiction does not allow certain limitations, those limitations apply to you only to the maximum extent permitted by law.

5. Your Responsibility

You are solely responsible for any Ad you post, any information you share, and any interaction, transaction, meeting, or agreement you enter into with another user or third party. You are responsible for verifying the identity, legitimacy, and trustworthiness of anyone you deal with through the Platform. Never send money, share banking or payment details, or share sensitive personal information based solely on an Ad. You use the Platform, and act on anything found on it, entirely at your own risk.

6. Prohibited Content and Conduct

You may not post content that is illegal, fraudulent, defamatory, harassing, hateful, obscene, or that infringes another person's rights. We may remove any Ad and may suspend or delete any account, at our discretion and without notice, including through the automated moderation and voting/deletion rules described on the Platform.

7. No Refund for Free Use

Posting a regular Ad is free. Paid Sponsored Ads and Banner Ads are optional visibility/promotion products; their scope (duration, placement) is described at time of purchase. Except as required by applicable consumer law, payments for promotion services are non-refundable once the promotion period has started.

8. Indemnification

You agree to indemnify and hold harmless LaLaLista and its operator(s) from any claim, demand, loss, or damage, including reasonable legal fees, arising out of your use of the Platform, your Ads, or your violation of these Terms or of any law or third-party right.

9. Changes to the Platform and These Terms

We may modify, suspend, or discontinue the Platform, in whole or in part, at any time, without liability. We may update these Terms from time to time; continued use of the Platform after a change means you accept the updated Terms.

10. Your Privacy and Data

How we collect and use data is explained in our Privacy Policy, including how to request deletion of your data.

11. Governing Law

These Terms are governed by applicable law without regard to conflict-of-law principles, to the extent permitted, and any dispute will be handled in the courts having jurisdiction over the operator, except where mandatory consumer-protection law grants you other rights.
